BitDynamic App User Agreement

BitDynamic (Shenzhen) Technology Co., Ltd. (hereinafter referred to as "BitDynamic") hereby specially reminds users to carefully read and fully understand this User Agreement (hereinafter referred to as "this Agreement"). Users should carefully read and fully understand all the terms in this Agreement, especially those terms that exempt or limit BitDynamic's liability, those regarding dispute resolution, and those on the applicable law. The terms that exempt or limit liability will be marked in bold, and you need to pay special attention to them. Please read carefully and choose to accept or not accept this Agreement (minors should read it carefully under the accompaniment of their legal guardians). Your use of the BitDynamic APP (hereinafter referred to as "this APP" or "this software") and other such actions will be deemed as your acceptance of this Agreement, and you agree to be bound by all the terms of this Agreement. If you do not agree to this Agreement, please do not use this APP. BitDynamic has the right to revise this Agreement, and the updated agreement terms will be published on this APP and will come into effect as of the date of publication.

I. General Provisions

1.1 This APP is software provided by BitDynamic for connecting headphones, glasses, and smart wearable products released by BitDynamic and its partner companies. The ownership and operation rights of this software and related services all belong to BitDynamic.

1.2 This Agreement is an agreement concluded between you (hereinafter referred to as "the user") and BitDynamic, its partner companies, and operation cooperation units (hereinafter referred to as "cooperation units") regarding the user's use of this APP and related services.

1.3 This software and services include:

• 1.3.1 The provided software offers software services such as connection and binding of BitDynamic devices and function setting management for users of BitDynamic. The specific software services are subject to those actually provided by this APP.
• 1.3.2 Updates, upgrades, and other services of this software.

1.4 Users must understand that BitDynamic only provides this software and related services to users. In addition, all the costs required for the devices related to this software and services (such as the cost of the software terminal and the Internet access fee for accessing the Internet) should be borne by the users themselves. At the same time, when using the software client and related services, users will consume resources such as their devices, bandwidth, and traffic.

II. Scope of Software License

2.1 BitDynamic grants the user a personal, non - transferable, non - sub - licensable, and non - exclusive license for this software.

2.2 Users can install, use, display, and run this software on a single mobile terminal device for non - commercial purposes. However, users shall not install, use, or run this software for commercial operation purposes. They shall not copy, change, modify, hook up to run, or create any derivative works of this software, the data released into the memory of any terminal device during the operation of this software, or the interaction data between the client and the server during the operation of this software. 2.4 Users can make a copy of this software only for backup purposes for the use of this software and services. The backup copy must contain all the copyright information in the original software.

2.5 Except for the express authorization in this Agreement, BitDynamic has not authorized other rights to the user. If the user wants to use other rights, they must obtain separate written consent from BitDynamic.

III. Software Upgrade

3.1 Users should download and install this software in the way authorized or specified by BitDynamic. Please note that do not download this software from unknown websites to avoid the mobile device being infected by malware, which may lead to damage to user data and allow malware to obtain user privacy information. If you obtain this software from a third - party without the authorization of BitDynamic or install a program with the same name as this software, BitDynamic cannot guarantee that the software can be used normally, and BitDynamic will not be responsible for any losses caused thereby.

3.2 Users must select the software version suitable for the terminal settings they install. Otherwise, any software problems, device problems, or damages caused by the incompatibility between the software version and the device model should be entirely the responsibility of the user.

3.3 In order to improve the user experience and perfect the service content, BitDynamic has the right to provide replacement, modification, and upgrade versions of this software for you from time to time. This software has the "upgrade prompt" function enabled by default for users. Depending on the software version used by the user, BitDynamic provides users with the option to choose whether to enable this function. After the release of a new software version, BitDynamic does not guarantee the continued availability of the old - version software.

IV. Usage Guidelines

4.1 Under the premise of complying with laws and this Agreement, users can use this software and services in accordance with this Agreement. Users shall not engage in the following behaviors:

• 4.1.1 Delete all copyright information on this software and other copies, and modify, delete, or bypass the technical measures set by this software to protect intellectual property rights.
• 4.1.2 Conduct reverse engineering on this software, such as disassembly, decompilation, or other attempts to obtain the source code of this software.
• 4.1.3 Modify or forge instructions and data during the software operation to increase, delete, or change the functions or operating effects of the software, or operate or disseminate to the public the software and methods used for the above purposes, regardless of whether these behaviors are for commercial purposes.
• 4.1.4 Use this software to engage in any behavior that endangers network security, including but not limited to: using unauthorized data or accessing unauthorized servers/accounts; accessing public networks or other people's operating systems without permission and deleting, modifying, or adding stored information; attempting to probe, scan, or test the weaknesses of the software system or network without permission or other behaviors that damage network security; attempting to interfere with or damage the normal operation of the software system or website, deliberately spreading malicious programs or viruses, and other behaviors that disrupt normal network information services; forging TCP/IP packet names or partial names.
• 4.1.5 Users log in to or use this software and services through third - party compatible software or systems not developed, authorized, or recognized by BitDynamic, or produce, publish, and disseminate the above - mentioned tools.
• 4.1.6 Without the written consent of BitDynamic, users shall not arbitrarily engage in the following behaviors with respect to the software and the information therein, including but not limited to: using, renting, lending, copying, modifying, linking, reprinting, compiling, publishing, establishing mirror sites, and arbitrarily developing derivative products, works, services, plugins, add - ons, compatibility, interconnection, etc. related to this software.
• 4.1.7 Use this software to publish, transmit, disseminate, or store content that violates local laws.
• 4.1.8 Use this software to publish, transmit, disseminate, or store content that infringes on the legitimate rights such as intellectual property rights and trade secrets of others.
• 4.1.9 Use this software to batch publish, transmit, and disseminate advertising information and spam.
• 4.1.10 Use this software and other services provided by BitDynamic in any illegal way, for any illegal purpose, or in any way inconsistent with the permitted use in this Agreement.

4.2 Information Publishing Guidelines

4.2.1 If you use this software to publish information content, you should ensure that you own the intellectual property rights of the information content you upload or have obtained legal authorization, and that any of your behaviors using this software and services do not infringe on the legitimate rights of any third party.

4.2.2 When using this software, users shall not use this software to engage in the following behaviors, including but not limited to:

• 4.2.2.1 Produce, copy, publish, disseminate, and store content that violates local national laws and regulations.
• 4.2.2.2 Publish, transmit, disseminate, and store content that infringes on the legitimate rights such as the right of reputation, the right of portrait, intellectual property rights, and trade secrets of others.
• 4.2.2.3 Fabricate facts and conceal the truth to mislead and deceive others.
• 4.2.2.4 Publish, transmit, and disseminate advertising information and spam.
• 4.2.2.5 Engage in other behaviors that violate local laws and regulations.

4.2.3 Without the permission of BitDynamic, you shall not conduct any commercial activities such as advertising and selling goods in this software.

4.3 Users understand and agree that:

• 4.3.1 BitDynamic will determine whether the user is suspected of violating the above - mentioned usage guidelines and, based on the determination result, suspend or terminate the user's license to use or take other restrictive measures as permitted by this Agreement.
• 4.3.2 For the information suspected of being illegal, suspected of infringing on the legitimate rights of others, or violating this Agreement published by the user when using the licensed software, BitDynamic will directly delete it.
• 4.3.3 For the damage caused to third parties by the user's behavior in violation of the above - mentioned usage guidelines, you need to independently bear legal liability in your own name and ensure that BitDynamic is exempt from losses or additional expenses arising therefrom.
• 4.3.4 If the user violates relevant laws and regulations or the agreement provisions, causing BitDynamic to suffer losses, be claimed by a third party, or be punished by an administrative authority, the user shall compensate BitDynamic for the losses and/or expenses incurred thereby, including reasonable attorney's fees and investigation and evidence - collection expenses.

V. Instructions on Third - Party Services

5.1 Users understand and agree that this software system may include services provided by BitDynamic's affiliated parties or third parties. BitDynamic only provides relevant function modules and usage entrances for third - party services in the system for the convenience of users' operations.

5.2 Whether the third - party services are pre - installed in this software system service or are independently activated or subscribed by the user, users understand and agree that BitDynamic does not make any express or implied guarantees or warranties regarding the legality and validity of the third - party service providers or the users' behaviors, nor regarding the legality, accuracy, validity, and security of the third - party services.

5.3 BitDynamic does not supervise third - party services, has no control over them, does not provide any form of guarantee or warranty for third - party services, and does not assume any liability.

VII. Liability for Breach of Contract

7.1 BitDynamic has the right to determine whether the user's behavior complies with the provisions of this Agreement. If it is considered that the user violates relevant laws and regulations or the provisions of this Agreement and relevant rules, depending on the severity of the user's violation, BitDynamic has the right to take measures against the user, such as deleting the illegal information, restricting, suspending, or terminating the user's use of this software service, pursuing the user's legal liability, and other measures that BitDynamic deems appropriate. If BitDynamic suffers any losses (including but not limited to receiving claims from any third party or penalties from any administrative department), the user shall bear full liability.

VIII. Service Risks and Disclaimer

8.1 BitDynamic provides service support with the current technology. BitDynamic does not guarantee that the software service will not be interrupted or error - free in operation, does not guarantee that all defects in the software service will be corrected, nor does it guarantee that the software service can meet all the user's requirements. BitDynamic will not assume any liability for the consequences arising therefrom.

8.2 BitDynamic will not be responsible for any losses suffered by the user due to third - parties, such as communication line failures, technical problems, network issues, computer terminal device failures, system instability, and other various force majeure reasons.

8.3 BitDynamic does not guarantee the legality, authenticity, accuracy, and validity of the information content obtained through this software (including but not limited to the content of third - party services invoked). BitDynamic will not be responsible for the results of any actions taken by the user based on inquiries and views.

8.4 Like most Internet software, this software may be affected by various security problems due to factors such as user reasons, network service quality, and the social environment. For example, others may use the user's information to cause harassment in real life; other software downloaded and installed by the user or other websites visited may contain viruses such as "Trojan horses", threatening the security of the user's terminal device information and data, and then affecting the normal use of this software, etc. Users should strengthen their awareness of information security and the protection of user information and pay attention to strengthening password protection to avoid losses and harassment.

8.5 When the user uses this software or requests BitDynamic to provide specific services, this software may invoke third - party systems or third - party software to support the user's use or access. The results of the use or access are provided by the third - party.
